For criminal jurisprudence, you can be only regarded as tentative and experimental; it is perhaps premature to embody in the form of an Ordinance provisions which, whether adequate or not, can be regarded as resulting from experience sufficiently extended.
It is also manifest that Your Grace can already control, by executive action of this Government, Criminals ordinarily liable to be released. Therefore, an Ordinance dealing with that subject could only operate as a restriction on Your Grace's existing authority, a restriction which might be extremely prejudicial to the public interests and for which there seems no adequate reason for creating by legislation.
As the Ordinance derives its authority from punishing them if they return when deported, he can deal with them in accordance with the engagements they voluntarily enter into.
I would therefore suggest that at the end of the year, I shall be better enabled to transmit such a report as may assist Your Grace to determine in what particulars, if any, the present system may require modification.
